Rules and Restrictions

For purposes of the Oster Homes Best New-Home Value Guarantee, "best new-home value" means the lowest monthly payment on a 30-year fixed rate mortgage for the purchase of a new home built, or to be built, for the same cost by any other builder in any new-home subdivision of not less than 25 homes located within Lorain County, Ohio. "Cost" means the total purchase price plus closing costs. "Builder" means a member of the North Coast Building Industry Association which builds no less than 10 homes per year. Build-on-your-lot homes are not eligible.

To be eligible for the Best New-Home Value Guarantee, you must register at an Oster Homes information center and complete an acknowledgment statement, confirming that you have received and reviewed this description and restrictions. To be eligible, you must qualify and be approved for the program being offered by the Oster Homes preferred lender.

Oster Homes must be given the opportunity to beat any better new-home value. In this regard, a purchaser must deliver a copy of a written price quote from the builder which shall include the name of the builder, a description of all options and option pricing, the floor plan and the financing package, to include interest rate, terms, down payment, monthly payment and closing costs. If Oster Homes does not agree to better this offer, it will pay the purchaser the sum of $1,000 upon completion of the purchaser's transaction with this builder, provided that no liability to pay shall exist until Oster Homes has had an opportunity to confirm the transaction and inclusion of all options, and in this regard purchaser must provide Oster Homes with the final Hud-1 Settlement Statement and the opportunity to walk through the home after closing. Oster Homes reserves the right to deny any claim which is not verified or for which incomplete information has been provided, or if Oster Homes has not been provided the final Hud-1 Settlement statement or the opportunity to walk through the home.

Oster Homes reserves the right to modify or cancel the Best New-Home Value Guarantee at any time without prior notice. Any modification will be effective upon posting of modified terms to the Best New-Home Value Guarantee on the OsterHomes.com Web site. Any cancellation will be effective upon removal of references to the Best New-Home Value Guarantee from the OsterHomes.com Web site.
